Hogwarts School of Witchcraft and Wizardry Contract of Employment

I. Parties

The Parties to this contract are the Board of Governors of Hogwarts School of Witchcraft and Wizardry (herein referred to as “the Governors”) and Minerva McGonagall (herein referred to as “the Teacher”).

II. Employment

The Parties hereby agree that the Teacher shall be employed in the position of Mistress of Transfiguration for a term of six months, effective 1 December 1956, subject to the terms of this contract.

III. Compensation

The Governors agree to pay the Teacher a sum of thirty (30) Galleons per month, payable on the first day of each month for the period of the annual school term.

The Governors agree to provide to the Teacher a pension equal to the amount of ten (10) percent of Teacher’s annual pay, subject to the terms set forth by the Wizengamot Administrative Services—Occupational Welfare Subcommittee (See British Code of Wizarding Regulations, Sect. 892.2).

The Governors agree to provide to the Teacher routine medical care to be conducted by a mediwitch or mediwizard in the employ of Hogwarts School of Witchcraft and Wizardry. Care will also be provided by a mediwitch or mediwizard in the employ of Hogwarts School of Witchcraft and Wizardry, or by other medical personnel at the discretion of the Headmaster, for any illness or injury suffered during the performance of the Teacher’s normal duties.

IV. Duties

The Teacher agrees to provide instruction in Transfiguration to students of Hogwarts School of Witchcraft and Wizardry. This shall include thirty (30) hours of classroom teaching, plus two (2) “office hours” per week, during which time the Teacher shall be available to students for consultation.

In addition, the Teacher shall be present at all communal lunch services during school term from Monday through Friday, and at one (1) communal dinner per week (schedule to be determined between the Teacher and Headmaster); exceptions subject to prior approval of the Headmaster.

In addition, the Teacher shall be present at all special events as requested by the Headmaster.

In addition, the Teacher shall provide additional chaperone services at the discretion of the Headmaster, not to exceed five (5) hours per month.

V. Indemnity

The Governors agree to indemnify the Teacher against injury or destruction of property suffered as a result of the performance of normal duties. A Life Assurance policy shall be provided against the accidental death of the Teacher in the performance of her normal duties. This shall consist of a sum equal to three (3) times the Teacher’s annual salary at time of death, and shall be paid to the Teacher’s estate or to an individual designated by the Teacher.

The Teacher and her estate agree to hold the Board harmless for death, and for any injury or destruction of property suffered as a result of the performance of normal duties.

The Board agrees to indemnify the Teacher against claims arising from death, injury, or destruction of property to a third party or parties that occur as a result of the performance of normal duties.

VI. Code of Conduct

The Teacher agrees to comport her-self at all times in a manner to reflect positively on Hogwarts School of Witchcraft and Wizardry. Pursuant thereto, the Teacher agrees to the following stipulations:

  1. The Teacher shall refrain from any contact with a student that is likely to result in physical or moral harm to that student, including, but not limited to:
    1. Corporal punishment, including, but not limited to:
      1. Beating, by hand or instrument, magical or ordinary;
      2. Hexes, jinxes, curses, or other application of magic designed to harm an individual or individuals;
      3. Other spells not designed to harm, but which may result in injury to an individual;
    2. Inappropriate sexual contact;
    3. Deliberate placement of a student into a situation that might result in physical harm.
  2. The Teacher shall refrain from using potions, herbs, Muggle pharmaceuticals, or other substances or spells that may impair judgement, except as a necessary part of medical treatment prescribed by a qualified mediwizard, mediwitch, or Healer.

VII. Research

The Governors agree to permit the Teacher to use the facilities of Hogwarts School of Witchcraft and Wizardry, including the following:

  1. Laboratories, at the discretion of the Headmaster;
  2. The Library;
  3. The Grounds;

for the purpose of conducting original research, with the following stipulations:

  1. The research may not violate existing Wizarding law;
  2. The research may not place the Teacher, Staff, or Students of Hogwarts School of Witchcraft and Wizardry in any physical, psychological, magical, or moral jeopardy;
  3. Proceeds of any research conducted by the use of the facilities of Hogwarts School of Witchcraft and Wizardry shall be shared between the Teacher and the School as follows:
    1. Direct sales of any materials resulting from the research: Teacher ninety (90) percent, School ten (10) percent in perpetuity;
    2. Fees derived from patent(s) resulting from the research: Teacher seventy (70) percent, School thirty (30) percent for a term not to exceed fifty (50) years.

VIII. Termination of Contract

This Contract may be terminated at any time upon the written agreement of both Parties.

Breach of any of the terms of this Contract by either Party shall be determined by a neutral party selected by the Department of Magical Education upon the request of the Governors, with remedy to be determined by same.
